Damages for Violations of Competition Law

SPECHT BÖHM Associate, Florian Heindler, has published an article in the leading Russian journal Competition and Law entitled, “Private Enforcement and Choice of Law in the European Union”. The article focuses on the specific conflict of laws rules concerning  tort claims arising from violations of competition law as set out in EU Regulation No. 864/2007 (“Rome II”).

The article was triggered by a judgement of the German Supreme Court of June 2011 (KZR 75/10) which is the first decision by a German court on the liability of the members of a cartel for damages suffered by customers of the cartel members. In awarding damages for violations of competition law, the Court based its decision on general principles of tort law. The judgement will therefore also be of interest in the context of violations of competition law affecting Austrian customers.
